TERMS OF SERVICE

COMMISSIONED WORK

By purchasing my art services, you automatically agree to the following conditions.
Please read this entirely and carefully. I will deny your request if I see you did not read this.  
Once requesting a commission from me, you must clearly state that you have read my terms of service. Only then will I begin to make business with you.
If there are any questions or concerns, email me at vilshanka.paypal@gmail.com. All    negotiations will be discussed over email, so you must have an active email account that you are willing to give me the address of.

PAYMENT
❖ All payment should be via Paypal. Payments will be accepted in USD as well as EUR, and they will be of equivalent value. Example being; I will accept a 100 USD payment or an equivalent 95,52 EUR payment.
❖ All payment should be made through invoice method. I will invoice you. DO NOT send me any payment, it will be refunded.
❖ You will receive the full unwatermarked image through your email. Once you receive it you must clearly state that you have received your digital purchase and that you are satisfied with it.
❖ Payment is due in full up front for any commission equal to or below $100 USD.
  For amounts greater than $100 USD, payment plans are available. These will depend on the price and your circumstances.  
  You will receive a small resolution for reviews in this case, and will receive the full resolution only after final payment is made.
❖ At least a partial payment is required within three days of your commission request being accepted
  Failure to do so will result in your request being dropped. If you need more time, let me know.
❖ Once our negotiation is done and I start your commission, I cannot refund you the full amount. This is negotiable depending on the state of the commission. If not touched on refunds requested for longer than a month will only have a 75% return from the net received.
❖ Once the work is completed I cannot refund it.

ARTIST
By commissioning me, you are purchasing my artist labor only. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion, unless otherwise agreed upon.

❖ I will respect your request to not publicly post your commission.
❖ Once the image is fully paid for and handed to the customer, I cannot claim the Intellectual Property or reuse/resell the image for personal and commercial projects. Unless agreed upon.
❖ I reserve the right to reject your commission proposal without question. This includes if you did not follow the rules for said order.
❖ I reserve the right to modify and resell any rejected sketches as "pre-posed" at a later date.
❖ I reserve the right to later modify and resell any completed images that were not handed to the customer due to lack of payment or violation of my terms of service.
❖ I reserve the right to not finish your commission if you violate my terms of service at any time after I have accepted your commission.
❖ I cannot charge you for anything else other than what we have negotiated and agreed upon.
❖ The quality of your image will be of equal value to what you paid for.

COMMISSIONER
The commissioner may upload the work done for you to your site as long as it is credited and linked back to any of my galleries. Once a piece is commissioned, you may use it for any personal use that you please, including but not limited to icons, signatures, layouts, wallpapers, themes and personal site display.

❖ You retain the rights to the IP.
❖ You may not claim the work to be your own, edit or set it up for redistribution. You may not use it for any external projects, commercial or non-commercial unless agreed upon.
❖ You may not request a chargeback from me unless we agreed upon it beforehand. This includes but is not limited to any sites that I would use to receive money for my services, for example Paypal.
❖ The chargeback may only be in the amount of money you; paid for my services with, agreed with me on, I stated as the price for my work, or any other instances where you were informed of the price for my work beforehand.
❖ If an unjust chargeback is requested against me I hold the right to privately/publicly contact any site where the chargeback was requested and explain them all of the details of our agreement, as well as provide them with screenshots proving my words.
❖ You may resell it for the price you purchased it with. As long as it is not for reproduction such as prints, t-shirts, mugs, charms, etc.
❖ If you are looking for something to redistribute, reproduce, use for your project(s), as an ad, for a video, to resell at conventions etc. Speak to me for information on royalty fees. If you have not spoken to me about it you may not use my work.

If you are not sure whether your request counts as personal, you may ask me about its intended use.

PROCEDURE
Preface. You understand that Vilshanka is not working with only your priorities in mind. You understand that Vilshanka has other responsibilities, and that those may come in-between or be prioritized over your commission. They will take steps that are time consuming and slow. Please do not commission them if you are looking for fast and timely work.
❖ After payment is received: I sketch, color and paint depending on your commission type.
❖ I do not accept "description only" commissions. You must have at least one visual reference.
❖ Sketch commissions do not have an approval stage. You may request minor tweaks if I missed any distinguishing features present in your reference.
❖ For larger, full color commissions, one large edit is allowed during the sketch phase. I reserve the right to add a $5 USD fee over any edits after the first one.
❖ Please be clear and concise in your description of the change. You can use other works and photos you like as references for the changes!
❖ A full size, no watermark image will be given. It is necessary that you use a watermark/resized version of the image before sharing publicly.
❖ I will not regularily contact you and keep you updated through the process of doing your commission. However you may contact me about it, many times if you wish.
❖ You may privately contact me and ask me about the progress of your commission.
❖ You may not harass, stalk, spam, black-mail me, or publicly contact/inquire/demand/shame me about the progress of your commission.

I DO NOT DRAW
Sexual violence . Watersports/Scat . Babyfurs/Diapers . Pedophilia . Necrophilia . Bestiality . Milking . Incest . Micro/Macro . Inflation/Weight Gain . Vore . Any sexual themes of characters that are underage . Anything else that I have not agreed upon

If you are not sure if I would accept your idea, please elaborate on your request privately at vilshanka.paypal@gmail.com.

The terms of service have been composed to protect the safety of the artist as well as the safety of the buyer. The artist’s terms of service are still valid even after the commission has been payed, completed, and sent through email to the buyer.

This document can and will be edited at any time without the need of further notice.

❖ Once the work is completed I cannot refund it.

ORIGINAL DESIGNS, ADOPTABLES
Adoptables are purchased designs which the buyer may use as their own character once the purchase has been made. Once buying an adoptable you are buying the design, the artwork, a community membership (if it is part of a species), and paying for the artist’s labor.  You may upload the adoptable to your site as long as it is credited and linked back to any of my galleries. Once an adoptable is bought, you may use it for any personal use that you please, including but not limited to icons, signatures, layouts, wallpapers, themes and personal site display.

❖ You may name the character, create a personality and background information for the character as well as make minor design changes, if you have gotten an approval for that. However you may not edit/alter the original art of the design, the world, or guidelines of the species you have purchased in any way.
❖ Alterations are not to be made to the original artwork and are limited to minor details. The character must still maintains the main features of the original design.
❖ When trading/gifting/selling the design I must be contacted about it. Please contact me before finalizing the trade, not after. That is so that the adoptable does not come into the possession of someone I do not approve of.
❖ When turning the design into a character you may not add your own rules/traits/conditions to its species, if it is a part of one. The owner of the species is the only one that may alter the species itself in any way.

SPECIES
Species are a fictional concept for animals/humans/worlds/creatures/universes/etc. created by someone. That person has the right to alter/set rules/condition their species, and has the right to choose whether anyone else also has such rights to their species.They may not however dictate how others should run their own species.

❖ You may not sell nor ask for any vouchers or monetary compensation for a design you traded for or did not purchase yourself. If you did not buy the design, you may not sell it or receive money for it in any way.
❖Designed and approved MYOs may not be sold. You may not ask for vouchers of any kind, monetary compensation, or gift cards. If the design is being traded for real world items, then the worth of said items must be the same or lower as that of the design. Designed and approved MYOs may only be traded/swapped for other designs, art, real world items, or can be gifted. MYO slots cannot be sold, traded, swapped, or gifted. Others can however design the MYO for you, but not in exchange for money.
❖ If you did purchase a design that you would like to sell or trade for a voucher, the voucher may not exceed the amount that you paid for the design.
❖ If you are trading the design for real world items I must be informed about it. Screencaps showing your proof of owning the design, said design’s worth, your permission to trade the design, and the agreed-upon transaction must be added. The person who the design is being traded to must be informed with said screencaps as well. After the trade is done, I must must be informed about the outcome of the trade, preferably with screencaps.
❖ I hold the right to cancel a trade, swap, or gift if I have reasons to believe that it has taken place in conditions of unjust nature.

ARTIST
By commissioning me, you are purchasing my artist labor only. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion, unless otherwise agreed upon.

❖ I will respect your request to not publicly post your commission/custom.
❖ By buying my custom/commission you are purchasing my labor and only a partial right to a design. Once the image is fully paid for and handed to the customer, I retain all copyrights over my art or work, which include but are not limited to the right to distribute, reproduce or use the image as a sample for sales/self-promotion, unless agreed upon. Once the design is fully handed over to the customer I no longer hold the right to sell/trade/swap/gift it to others, unless the customer violated my Terms of Service; if that happens I receive back my rights to sell/trade/swap/gift said design.
❖ I claim all rights to the Intellectual Property, but I will not reuse/resell the design again for personal and commercial projects.

❖ I would ask you to inform the person you are selling/trading/swapping/gifting the design to about the origin of the species, that includes but is not limited to its original author/artist/species/universe/etc.
